I don't think Atari ever made a public statement that it is in the public domain. So it's not abandonware
Meaning we can't mention or point to downloading the game online in any video. We can only state that you should get a copy in some way.
But it also isn't sold by atari itself anymore

You can buy physical discs. But I don't think Atari are making any money of it anymore...
IDK, It takes a really long time for it to enter the public domain without it being done manually
Yes it is pretty old it was for PS2 if I got it right
Ps2 is no near old enough
Maybe when I'm 75 ish it will be in the public domain
But like if you'll buy it on PC you will also need a patch
