the way rubin phrased it it was not that bad but maybe we should just get rid of the rules since they don't have much meaning anyways and it depends on many details you cannot take into consideration when writing rules

Pretty much. Rules are/should be based on common sense. If someone doesn't have that, then any amount of text will change nothing. If the user doesn't know basic behaviour, then they can't be in any community.
